3.1.https://www.footpatrol.ie/ is a website operated by John David Sports Fashion (Ireland) Limited (trading as Footpatrol) whose company number is 448434 and registered address is Fitzwilliam 28, Fitzwilliam Street Lower, Dublin 2 D02 KF20 and our VAT registration number is IE9673400C. We are a private company limited by shares (referred to as "we", "us" or "our" throughout these terms and conditions.

4. OTHER TERMS THAT MAY APPLY TO YOU
4.1.These terms refer to the following additional terms, which also apply to you:
· our Website Terms, which explain the rules for using the Website;
· our Privacy Policy, which explains how we collect, use and store your personal data; and
· our Cookie Policy, which sets out information about the cookies on our Website.
5. WE ONLY ACCEPT ORDERS WHEN WE'VE CHECKED THEM
5.1.The Website displays product(s) which are advertised for sale and gives information about them (the "Product(s)").
5.2.After placing an order we will contact you to confirm we have received your order but we only accept the order when we dispatch the Product(s). The contract between us will only be formed when we send you the confirmation that the Product(s) have been dispatched.
We are not obliged to accept any orders and sometimes we reject orders, for example, because a Product(s) are unexpectedly out of stock, because you are located in a country which we do not deliver to, or because the Product(s) were mispriced by us. When this happens, we will let you know as soon as possible and refund any sums you have paid.
6. PRODUCTS CAN VARY SLIGHLTY FROM THEIR PICTURES
6.1.Although we have made every effort to ensure that the images are accurate, we cannot guarantee that a device's display perfectly reflects the colour of the Product(s). The true colour of Product(s) may not exactly match that shown on your device or in our marketing or its packaging may be slightly different.
7. ORDERING AND DELIVERY PROCESS

8. PRICE, DELIVERY CHARGES AND PROMOTIONS
8.1.We charge you when you make an order for Product(s). Prices for Product(s) and delivery charges are as published on the Website and as shown to you during the checkout process.
8.2.Subject to separate delivery charges, all prices shown for Product(s) include appropriate value added tax or similar tax (“Sales Tax”) applied on the sale or dispatch to your delivery address. No Sales Tax reclaim, refund, or adjustment of the purchase is required, or possible, for purchases made on our Website irrespective of the country you are shopping from or have the order delivered to.
8.3.Delivery charges are additional to the price of the Product(s) and are clearly displayed during the checkout process. Full details of our delivery charges can be found here.
8.4.There may be additional charges such as taxes or custom charges if you place an order for international delivery. Such charges are not controlled by us and we recommend contacting your local customs authority to understand the costs prior to placing an order. 8.5.We may amend prices at any time. If the price of Product(s) differs between the time the order is placed and the time of dispatch, we may reject the order. In such cases, any payment already made will be refunded, and you will be informed of the order cancellation.
8.6.Offers and promotions that we offer are subject to availability and additional terms and conditions. We may change or withdraw them at any time and without notice. Nothing shall oblige us to maintain offers or promotions for any period.
9. PAYMENT METHODS
9.1.We accept most well-known payment methods, including but not limited to:
VISA Debit, VISA, Mastercard, Apple Pay, Google Pay, Paypal, American Express, Maestro, Gift Cards, and Shop Pay.
9.2.By placing an order, you confirm that you are the authorised cardholder or account holder (as applicable). All charges are subject to validation and security checks as well as authorisation by the provider and any additional terms imposed by the provider. If the provider does not authorise payment, we will not accept your order and will not be liable for any delay or non-delivery.
9.3.Your provider may charge you for using you a payment method on our Website. Please check the terms and conditions with your provider carefully and in advance of submitting your payment details.
9.4.Buy Now Pay Later. We have arrangements with third-party providers who you can apply to for options to spread the cost over a number of payments to that third party. If you are eligible for this, this will be based upon a separate arrangement between you and the applicable third-party provider. The terms of these arrangements are between you and the third-party provider, and not us. Please check the terms and conditions with the provider carefully in advance of submitting your payment details.
9.5.We currently accept “buy now pay later” options with these providers:

10. YOU CAN CHANGE YOUR MIND
10.1.For most of our Product(s) bought online, you have a legal right to change your mind about your purchase and receive a refund of what you paid for it, including the standard delivery costs. If you opted for a different delivery service, we will refund the cost of the standard service. This is subject to the conditions below.
10.2.In addition, we offer our Irish customers a goodwill guarantee for most Product(s) bought online, which is more generous than your legal rights in the ways set out below. This goodwill guarantee does not affect your legal rights if there is something wrong with your Product(s).

10.3.You can't change your mind about an order for:
· Product(s) sealed for health protection or hygiene purposes, once these have been unsealed after you receive them;
· perishable Product(s) if the protective seal has been tampered with or is broken; or
· Product(s) that are made to your specifications or are clearly personalised.
11. EXCHANGES
11.1.We do not offer exchanges for any Product(s). If you are not satisfied with your purchase, please refer to our returns portal here for information on available options. Nothing within this clause shall limit your statutory right to a replacement, return or repair in circumstances where the Product you receive:
a) Does not match the description, sample, or model provided by us;
b) Is not of the type, quantity, or quality agreed between us;
c) Is not fit for the purposes for which goods of that type are normally used;
d) Does not possess the qualities and performance capabilities indicated in advertising or labelling;
12. RETURNS
12.1.Irish Customers: Irish customers can return Product(s) purchased on the Website for free via our approved courier. To do this, you will need to register your return on our returns portal which can be accessed here. Product(s) must be returned within 28 days from when you receive your order.
12.2.Non-Irish Customers: For customers outside of Ireland, you have to return the Product(s) at your own cost. If you do this, you should keep a receipt or other evidence from the delivery service that proves you have sent it and when you sent it. If you don't do this and we don't receive the Product(s) at all or within a reasonable time, we won't refund you the price.
12.3.To ensure your return is processed correctly, you must include a returns label or reference that links the return to your original order. Failure to provide this may result in delays or an inability to process the return. Non-Irish customers must return any Product(s) to the following address: Footpatrol Internet Returns, Door 2, Michael Faraday Avenue, Milnrow, Rochdale. OL16 4FW
12.4.Refund times will vary depending upon the original payment method you used to buy the Product(s), but we will aim to process your refund or replace the Product(s) as soon as possible. Where a refund is due under your statutory rights, we will issue the refund within 14 days from the date we receive the returned Product(s).
12.5.If you cancel your whole order, we will refund the price of the order together with any standard delivery charge paid. If you chose to pay extra for express delivery, we will only refund the cost of standard delivery. If you want to return only some Product(s) but keep the rest of your order, you won’t be entitled to a refund of the delivery charge.
12.6.We will refund you using the same method that you used to buy the Product(s). For purchases made using a Gift Card, refunds are made to that Gift Card. See our Gift Card terms and conditions for more information.
12.7.Should you choose to cancel or return Products purchased in a promotion or at a discounted price, you will be refunded for the Products at the price charged at the checkout.
13. CANCELLING AN ORDER PRIOR TO DELIVERY
13.1.Once an order is placed, you cannot prevent its delivery, but you may cancel the order by returning the Product(s) as set out above after you have received the order. A refund will only be issued once the returned Product(s) have been received and processed in accordance with our returns policy.
14. YOU HAVE RIGHTS IF THERE IS SOMETHING WRONG WITH YOUR PRODUCT(S)
14.1.Please let us know when returning Product(s) what you think the issue is. If you return the Product(s):

If any Product(s) are defective, you may be eligible for a repair, or an in-store replacement (subject to availability), or a refund (including standard delivery costs), in line with the applicable warranty for the Product(s) and consumer rights. |
14.2.If a repair or replacement isn’t possible then you choose to either: (1) keep the defective Product(s) and agree a reduction in price; or (2) return the Product(s) and obtain a full or partial refund. If you have had the Product(s) for more than six months, any refund may be reduced to reflect the use and benefit you have already received.
14.3.Once we receive the returned Product(s), we will inspect them to determine whether a manufacturing defect or other fault exists. If a fault is confirmed, we will issue a refund which will include:
· the price paid for the Product(s);
· any standard delivery charges you paid (excluding express or premium delivery); and
· the reasonable cost of returning the Product(s) to us using our approved returns method.
If you choose a more expensive return method than the one we recommend, we may limit the refund to the cost of the recommended method.
14.4.We may not find any manufacturing fault or defect if:
· the defect or fault is caused by usual wear and tear;
· the defect or fault is caused by damage caused deliberately or accidentally;
· the defect or fault is caused by your negligence or your failure to follow product instructions; or
· the Product(s) have been misused, altered or repaired without our approval.
14.5.If we do not find any fault or defect in the Product(s), or we believe that they have been damaged other than by a manufacturing defect or fault, then your cancellation and refund rights are limited to those set out in section titled: “You Can Change Your Mind”.
15. WE DON'T COMPENSATE YOU FOR ALL LOSSES CAUSED BY US OR OUR PRODUCT(S)
15.1.This section explains what losses we are not responsible for and why. However, please also note that your statutory rights are not affected. This means that whatever you are entitled to as a matter of law, which cannot be altered or excluded, is not affected.
15.2.We are not responsible to you for losses:
· that were unforeseeable at the time the contract between us was formed;
· arising as a result of misuse of the Product(s) or normal wear and tear;
· that are outside of our reasonable control (provided we have taken the steps set out in section 17 below); or
· which are avoidable (i.e. something you could have avoided by taking reasonable action, including following our reasonable instructions for use).
15.3.We only supply the Product(s) for private use. If you use the Product(s) for any commercial, business or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
15.4.Nothing in this section limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
16. WE ARE NOT RESPONSIBLE FOR DELAYS OUTSIDE OF OUR CONTROL
16.1.If our supply of Product(s) is delayed by an event outside of our control, such as adverse weather, war, flood, fire, trade dispute, lack of third party materials or services or terrorist attacks, we will contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we won't compensate you for the delay, but if the delay is likely to exceed 30 days, you can contact us to end the contract and receive a refund for any Product(s) you have paid for, but not received.
17. OUR RIGHTS IN THE PRODUCT(S)
17.1.We do not transfer any intellectual property rights in the Product(s) to you, including any designs, trade marks, brand names, images and logos. This intellectual property is and shall remain our property or those of our licensors. At no time shall any rights, title or interest in the intellectual property rights pass to you.
18. HOW WE MAY USE YOUR PERSONAL INFORMATION
18.1.We will only use your personal information as set out in our Privacy Notice. You can read it here.
19. YOU HAVE SEVERAL OPTIONS FOR RESOLVING DISPUTES WITH US

19.2.Resolving disputes without going to court. If you would prefer to resolve your complaint without initiating legal proceedings, please contact our Customer Care team via our online form here. We offer free mediation to help resolve your issue as quickly as possible.
19.3.You can go to court. These terms are governed by Irish law and the Irish courts and if you live in the European Economic Area or the UK, you can bring claims against us under your local laws and in your local courts. We likewise may choose to bring claims against you in your local courts where you are resident.
20. OTHER IMPORTANT TERMS THAT APPLY TO OUR CONTRACT
20.1.These terms are between you and us. You may not transfer or assign your rights or obligations to another person without our express agreement. We may transfer or assign our rights and obligations under the terms or appoint third parties to assist us in performing our obligations at any time provided that this will not reduce our obligations to you or restrict your statutory rights. If we do transfer or assign our rights or obligations, we will notify you in advance. If you do not wish to continue the contract with the new entity, you may terminate the contract without penalty.
20.2.If any clause of these terms is found in any way to be void by a Court or other competent authority then all other clauses of the terms will continue to apply.
20.3.This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.
20.4.We might not immediately chase you for not doing something (like paying) or for doing something you are not allowed to, but that does not mean we cannot do it later.
20.5.We may make changes to these terms from time to time, for example, to reflect changes in the law or to our services. If we make any important changes (i.e. changes that would alter your rights or obligations) we will notify you in advance. If you do not agree to the updated terms, you may terminate the contact without penalty. The most up-to-date version of our terms will always be displayed on the Website, so please have a look before placing an order for our Product(s) to ensure you know about any changes which may have been made since your last visit to the Website.
Ordering and Delivery Process
Step 1 - Choosing your Product(s)
You can select Product(s) for purchase by clicking on the item which you are interested in and then clicking on "Add to Basket".
Step 2 –Reviewing your Basket
You can review the Product(s) which you have added to your basket. you can change the contents of your basket by amending the quantity of Product(s) you want to order (which may be subject to a maximum number of items, per size from time to time), removing any unwanted items by clicking “Remove” and viewing the basket total value. You can then continue shopping and adding to your basket if you wish or if you don't want to buy anything else, go straight to the next step.
Step 3 – Going to Checkout
Once you have finished shopping, you will then be asked to choose your delivery options. You can also enter any voucher code which you may have. Entering a valid voucher code and clicking “Apply” will update the basket total. Once you have done this, you should select “Proceed to Secure Checkout”.
Step 4 – Completing your Billing & Delivery Address
If you are an existing Customer and you have already logged in, the billing address details you can choose to have your previously entered details to appear. If you are not logged in, or if this is your first visit, you will be asked to enter your billing address. You will then be asked to enter your delivery address. You have the option of selecting the same address as your billing address. You then have the option to review your delivery option at this point. You must provide us with the correct address details.
Step 5 – Entering your Payment Details
You will then need to enter your payment details. Please check this information very carefully. If you are logged in as an existing customer and you have previously saved your payment details, they will appear here. If you want to check your order, your order summary page will be in the right hand corner. This includes details of the Product(s) in your order. You should check the details at this stage very carefully as this is the final stage in the order process at which you can correct any mistakes or change the Product(s) which you want to order. You can do this by returning to the home page and completing the process set out above again. If you are happy with your order, click “Continue Securely”.
Step 6 – Placing your Order
By clicking on “Continue Securely”, you are confirming that you have read, understood and accepted thesetTerms and that proceeding will put you under an obligation to pay us for the selected Product(s). At this point, your details will be submitted to us.
Step 7 – Order Acknowledgement
Once we have received confirmation that your payment has been authorised, a screen will appear, thanking you for your order. You will be given an order reference and an e-mail will be sent to you to acknowledge your order. It will confirm the Product(s), price and any delivery charge. It will also include a link to these terms. Print a copy of the order acknowledgment, terms and e-mail and keep them for your records. Please note, our acceptance of your order (regardless of the content of any emails we send you) will only take place on despatch of your order.
We may refuse your order or cancel your order if we decide it is reasonable to do so which may include circumstances where:
· we are unable to obtain authorised payment or the payment process is incomplete; or
· we identify a product or pricing error on the Website; or
· you fail to meet any criteria for eligibility of purchase which we may impose from time to time; or
· we suspect that your order is related to fraudulent activity; or
· you fail to submit all necessary and relevant details to allow us to fulfil the order; or
· Product(s) are unavailable or out of stock; or
· we have concerns regarding previous orders placed at the same address, including repeated missing delivery claims, which may indicate potential misuse of our ordering system; or
· we reasonably believe the order is intended for resale purposes and does not align with our intended consumer purchasing policy; or
· any other reason where we determine that fulfilling the order would not be appropriate or reasonable.
We may contact you by telephone or email to verify details before we are able to process and despatch your order or we may be unable to accept it. For example, we may do this if your order is of particularly high value.
The Product(s) shown for sale on this Website are intended for private, consumer use and you must not resell Product(s) or offer them as a commercial enterprise. We reserve the right to limit the total value of Product(s) which can be included in an order. If the total value of Product(s) in your bag exceeds the limit which we may choose from time to time, then we will contact you.
Delivery
Delivery dates specified on our Website and in any correspondence are estimates only.
Product(s) will be delivered to the address that you provide to us during the order process. So that our Product(s) can reach you, please make sure you provide a valid address for delivery. The delivery method that we use may vary depending on the nature and number of the Product(s). Please leave it down to our carriers to choose what they think is the most appropriate delivery method for the Product(s).
We will always try our best to meet all delivery times we communicate to you, but sometimes there may be delays – e.g. because of postal/carrier delays, logistics or bad weather. We will keep you updated as much as we can and you should be able to track your parcel’s progress.
If you have specific delivery instructions, we will do our best to pass this to our delivery partners (i.e. parcel carrier and delivery companies) so they can help deliver your parcel efficiently as possible, but we cannot be held liable for any parcels that are lost or stolen as a result of any specific delivery instructions left for the carrier.
Sometimes we may have to make alternative arrangements for delivery, which will depend upon the carrier we use to deliver the Product(s). This could include leaving the Product(s) with a neighbour or in a safe place at your property if we need to.
We understand it can be disappointing if your Product(s) aren’t delivered on the date expected. We might not be aware of this, so we ask you to notify us of a non-delivery within 30 days of the failed delivery so that we can take steps to rectify this.
We do our best to offer international delivery, but we can’t promise that all Product(s) we sell are eligible for it due to the carrier’s restrictions. Don’t worry, we will make you aware of this either by detailing this in the product description of the Product(s) or at the checkout or, in limited circumstances, we may have to cancel your order and issue you with a full refund.
Delivery Restrictions
As a result of various international carrier restrictions, certain Product(s) we sell are not eligible for international delivery. This will either be detailed in the item product description, at the checkout stage when you add such items to your basket or, in limited circumstances, we may have to cancel your order and issue you with a full refund.
