Footpatrol Chance to Purchase Promotion Terms and Conditions
By taking part in a Footpatrol Chance to Purchase promotion, you accept and agree to these terms and conditions. If you do not agree with any of these terms and conditions then you should not take part in the promotion. It is your responsibility to ensure that you review the terms and conditions before entering the promotion. JD Sports Fashion Plc t/a Footpatrol (“JD”) recommends that you print and store or save a copy of these terms and conditions for future reference during the promotion.
JD is the promoter of this promotion, which runs on the Footpatrol website in conjunction with our third party draw provider EQL Launches Pty Ltd (“EQL”). Use of the EQL platform is subject to EQL’s standard terms and conditions, in addition to these terms and conditions.
1. What can you win?
Each draw run by JD under these terms and conditions (a “Draw”) gives eligible entrants the chance to be selected to purchase one of the products identified on the relevant draw page (the “Item”). If you are selected, your entry will be converted into an order for the Item using the payment and delivery details you provide at entry (subject to eligibility/verification checks and successful payment processing) (“Chance to Purchase”). Sizes/variants are selected at the time of entry. The total number of winners will not be displayed and will depend on the actual stock available at the time of the draw.
A Chance to Purchase is subject to availability (including availability of sizes, styles and colours). A Chance to Purchase may not be exchanged for a cash value, nor is it transferable. A Chance to Purchase is subject to validity of the entry details (including JD’s ability to process payment). JD has the right to change, alter or withdraw the promotion at any time due to any change in any applicable law or any event outside the control of JD. JD shall not be responsible for any delay, cancellation or rescheduling of a Chance to Purchase.
Chance to Purchase is personal to each winner and must not be sold, transferred, resold, donated, or exchanged. JD reserves the right to withdraw the Chance to Purchase and/or make an entry void if this term is not complied with.
2. What is excluded from the Chance to Purchase?
Delivery fees (if applicable) will be payable by winners and will be confirmed during entry. The cost of the Item itself is not included within the Chance to Purchase and must be paid for by the winner. Unless expressly stated otherwise, all other costs and expenses not included within a Chance to Purchase are the responsibility of the winner.
Discount codes, promotional codes or other vouchers cannot be applied to any purchase made as a result of a successful Draw entry.
3. Who can enter?
Entrants must be:
· aged 18 years or over on the date of entry; and
· have a verified email address.
Geographical restrictions may apply.
JD reserves the right to ask for proof of age and the right (at its sole discretion and/or in conjunction with EQL) to decide if the eligibility criteria are met. If the eligibility criteria are not met, the entry will be invalid.
4. How to enter
Each Draw will be open for entry during the period stated on the relevant draw page (the “Draw Period”). Any entries received outside the Draw Period will not be valid.
You can enter a Draw on the Footpatrol website via EQL’s plugin by:
1. locating the relevant Draw on the Footpatrol website;
2. entering valid credentials and completing the applicable verification process with EQL; and
3. selecting the required size/variant and completing the requested payment and delivery details, including your preferred delivery method on the Footpatrol website. Details submitted at the time of entry cannot be amended and, if you are selected, will be used to process your order.
When you enter the Draw, a payment authorisation/verification check will be carried out using the payment details provided (which may appear as a £0 hold). You will only be charged if you are successful in the Draw.
Only one entry per customer is permitted for each Draw and any duplicate entries will be void.
All entries are subject to a multi-step verification process, which may include identity and eligibility checks, to ensure that only genuine individual entries are permitted and that entries are not made using automated or fraudulent means.
JD and/or EQL (as applicable) reserve the right, in their sole discretion, to reject or invalidate any entry, withhold or withdraw a Chance to Purchase, and/or disqualify an entrant if they reasonably suspect a breach of these terms and conditions (and/or EQL’s standard terms and conditions) or any fraudulent, dishonest or improper conduct. This includes, without limitation:
· manipulation of codes or the entry process;
· the submission of multiple entries (including computer-generated entries);
· use of scripts, bots or other automated means;
· falsification of data; and
· any other conduct which, in JD’s and/or EQL’s opinion, undermines the fair operation of the Draw.
If an entry does not pass EQL’s checks, it may be rejected or treated as invalid. Entries must be made personally by the entrant; entries made through agents or other third parties, bulk entries or automated entries are invalid and void.
Winners will only receive a Chance to Purchase if JD is able to process payment using the details provided.
No responsibility is taken for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason.
Cancelling your entry
Entrants may cancel their entry at any time up to the Draw closing date by visiting the relevant draw page and submitting a withdrawal request.
Once a winner has been selected and the order has been processed, the order cannot be cancelled. Items purchased following a successful Draw entry are subject to JD’s standard Returns Policy.
5. How are winners selected?
Winners for each Draw are selected using EQL’s Run Fair® draw mechanism which operates a randomised number generator and selection process administered by EQL, subject to verification checks (as set out above).
Winners will be randomly selected following the Draw closing time (usually within one hour) and will subsequently be notified by email to the address used to enter. If you are selected, and subject to successful payment processing, your entry will be converted into an order for the Item and you authorise JD to take payment for the Item (plus any applicable delivery fee) using the payment details you provided at entry; once payment is successfully processed, you will receive an email order confirmation.
If payment cannot be successfully processed, the entry will be treated as unsuccessful, no payment will be taken, and an alternative winner may be selected. In this situation, the entrant will receive a notification confirming that they were not successful. No opportunity to retry payment will be provided.
Non-winners will receive an email stating they have not won and no payment will be taken. JD is not responsible for any emails missed by winners or non-winners.
The decision of JD (and EQL, as applicable) is final and binding on all entrants.
Increased chance mechanism (EQLizer Score)
If you make an eligible entry that passes EQL’s verification checks but you are not selected as a winner for that Draw (an “Unsuccessful Entry”) EQL will apply an “EQLizer Score” to your profile for future Footpatrol Draws operated via EQL. For the purposes of the EQLizer Score, any entry that is not selected as a winner, including where payment cannot be successfully processed, will be treated as an Unsuccessful Entry.
The EQLizer Score forms part of EQL’s draw mechanism and is designed to enhance your chances in future draws following an Unsuccessful Entry. With each Unsuccessful Entry, your score increases, thereby improving your odds of selection in subsequent draws provided that any future entry is made using credentials that EQL matches to the entrant’s EQL profile.
For each Draw you enter, EQL generates one or more randomised entry numbers based on your EQLizer Score. Where multiple numbers are generated, the most favourable (i.e. lowest) number is used as your entry for the purposes of the Draw. Entries are then processed in order of those numbers, subject to availability of the entrant’s selected size or variant at the relevant point in the selection process.
If your entry is successful, your EQLizer Score will reset. If you do not enter a subsequent Draw, any EQLizer Score applied to your profile may carry forward to future Draws, but it may expire or otherwise be subject to time-based or other limitations. The EQLizer Score does not guarantee selection or a Chance to Purchase. The increased chance applies only within future Footpatrol Draws operated via EQL and does not carry over to other retailers or Footpatrol promotions not run with EQL. 6. Winners’ Responsibilities
It is the winners’ responsibility to: (i) complete all stages of the How to enter section above; (ii) provide accurate details; (iii) provide valid proof of age; and (iv) comply with these terms and conditions, any applicable laws and any applicable terms and conditions communicated by EQL. JD will not be liable to any persons where they fail to comply with such responsibilities and any such failure may result in forfeiture of the Chance to Purchase.
7. Personal information
EQL will act as an independent controller in respect of the entry-related personal data it collects and uses to administer and operate the Draw (including for fraud prevention, eligibility verification, selection and winner designation). EQL may also use your entry information to communicate with you in connection with the Draw (including to confirm entry status, request information to complete verification checks and notify you of the outcome). EQL’s privacy notice will be presented to you when you participate in the Draw and will govern that processing.
JD will act as an independent controller in respect of customer and order information processed within JD’s Shopify environment (including via JD-controlled merchant checkout) for the purposes of creating and administering any order that results from a successful entry, taking payment, arranging delivery, dealing with customer service queries and communicating with you in relation to your order, as well as complying with applicable legal obligations.
Accordingly, both EQL’s and JD’s privacy policies apply:
· EQL’s Privacy Policy;
· Footpatrol’s Privacy Policy.
8. Which law applies to this promotion?
These Terms and Conditions and all Draws are governed by the laws of England and Wales and participants submit to the exclusive jurisdiction of the courts in England and Wales.
